The International Association of Scientific, Technical and Medical Publishers (STM) has joined the Association of American Publishers (AAP), the Independent Book Publishers Association (IBPA), and Copyright Clearance Center (CCC) in filing an amicus brief supporting the plaintiffs in In re: OpenAI, Inc. Copyright Infringement Litigation before the U.S. District Court for the Southern District of New York.
The litigation consolidates several copyright lawsuits against OpenAI involving allegations that copyrighted works were used without authorization to train its artificial intelligence models. The proceedings also include claims against Microsoft concerning its involvement with OpenAI. The court's decision is expected to mark the first opinion by a New York court addressing copyright issues related to AI training.
The amicus brief supports the authors, publishers, and news publishers involved in the litigation. It argues that established copyright principles remain applicable when copyrighted materials are used to train generative AI models. The brief also highlights the expanding market for licensing copyrighted content for AI applications and maintains that the fair use doctrine should adapt to technological developments without undermining copyright owners' rights.
